Attorneys

Caymanian attorneys or those possessing Caymanian status can apply for membership in the CBA by completing the CBA Membership Application Form and forwarding it to the Secretary of the CBA with the requisite membership fee.Each Member must agree to be bound by the Memorandum and Articles of Association of the CBA, its Rules and By-Laws.

Membership applications will be heard at each meeting of the CBA Council and applicants will be notified as soon as practicable after such meeting. The Council usually meets on a monthly basis.

 

 

 

 

Students and Articled Clerks

Caymanian students currently enrolled in law school or the Bar Vocational/Professional Practice/Legal Practice course and who are in good standing with their institutions, can apply to become Honorary (Student) Members of the CBA by completing the Honorary (Student) Membership Application Form  - Law Students and forwarding it to the Secretary of the CBA.   Articled Clerks may also join as Honorary (Student) Members by completing the Honorary (Student) Membership Application Form - Articled Clerks. There is no membership fee associated with Honorary (Student) Membership.

Pursuant to the Legal Practitioners Law (2010 Revision) a complaint against a Cayman Islands attorney should be made to the Chief Justice with a copy of such complaint sent to the Attorney General. The Chief Justice will make an assessment regarding the gravity of the complaint and will decide what action should be taken.

The attoney must be given notice of the complaint and an opportunity to call witnesses and to be heard.

The Chief Justice has powers to suspend an attorney from practising for a specified period or to strike him or her from the Court Roll entirely. The penalty of striking from the Court Roll is reserved for matters of grave misconduct.
